Key takeaways
  • Moving home is not automatically a penalty-free cancellation: service equivalence and the evidence matter.
  • Article 133 requires written communication, supporting proof and at least 30 days' notice for its qualifying circumstances.
  • Cooling-off is a separate route: generally 14 days for a distance service contract, 30 for contracts signed at your home.
  • Keep the end-date confirmation, itemised final bill and equipment-return receipt; stopping payment does not cancel the contract.

Cancelling Portuguese internet, TV or telephone service starts with identifying the route, not with cancelling a direct debit. An ordinary cancellation during fidelização, a statutory right to terminate without a loyalty penalty, suspension and withdrawal from a recent distance contract have different conditions. This guide is for a consumer's personal contract. Business contracts and bundled equipment need their own assessment; it does not decide a disputed case or submit a cancellation for you.

Can I cancel without a loyalty penalty when I move house?

Article 133 covers a change of permanent residence when the operator cannot provide the contracted service or an equivalent service at the new address, including its characteristics and price. Ask the operator to assess the actual address and confirm the proposed technology, included services, price and conditions in writing. 'We have coverage' and 'the service is equivalent' are not necessarily the same statement. A more expensive replacement is not automatically equivalent merely because it has internet access.

If relying on that right, communicate in writing, including by email, give at least 30 days' notice and attach documentation proving the new residence. Keep the coverage/equivalence response with the request. The operator can still charge for service during the notice period. Do not turn the rule into 'all bills disappear', and do not assume a refusal to accept any replacement establishes your entitlement without checking the proposal.

For the other records and contracts affected by the move, use the Portugal moving-house checklist. Updating the billing address, transferring a service and ending the old service are different outcomes. Ask whether a proposed transfer requires a new commitment, rather than assuming your existing end date is preserved.

What if I am emigrating, unemployed or unable to work?

Article 133 separately describes an unpredictable permanent move to a país terceiro. Its proof route is a residence certificate or a work/services contract demonstrating the need to live in that destination. Keep the reason the move was unpredictable and the relevant dates. The wording is not an unconditional exemption for every overseas move: for a disputed destination or planned departure, ask for written clarification of the legal ground instead of assuming the fee is waived.

The unemployment branch requires employer-initiated dismissal for a reason not attributable to the worker, plus an income reduction of at least 20%. The incapacity branch covers permanent incapacity or temporary incapacity lasting more than 60 days, also with at least a 20% reduction. The law compares the consumer's relevant income in the month of the event with the previous month. It includes gross salary, gross self-employed invoicing, gross pensions and regular benefits or other regular income—not simply the amount left in a bank account.

The unemployment evidence can come from the employment centre or Social Security. Keep documents proving the income change; for incapacity, also obtain evidence of the situation and duration. Article 133's written notice and minimum 30-day period still apply. Voluntarily leaving a job or reporting that bills feel unaffordable is not the same as demonstrating the statutory dismissal-and-income conditions.

Is suspension an alternative to immediate cancellation?

Article 137 has a separate suspension route, including loss of the premises, residence outside Portugal, unemployment or medical leave and specified prolonged illness/dependency situations. Its conditions are not interchangeable with Article 133's termination conditions. Tell the operator which route you are requesting and obtain written confirmation of the start date and what happens to service and billing. Do not silently stop using the connection and call that suspension.

A qualifying suspension lasting more than 180 days can lead to expiry of the contract at the holder's request; it is not an automatic cancellation on day 181. In the illness/dependency branch the representative can act as the law permits, with supporting evidence. Qualifying suspension/expiry does not itself generate charges, including early-termination charges. Retain the request and confirmation and distinguish it from an unpaid bill or an operator's suspension for non-payment.

Do I have 14 or 30 days to change my mind?

For a service contract concluded at a distance, such as by phone or online, Article 10 of Decree-Law 24/2014 generally provides 14 days from the contract's conclusion. The period is 30 days for the specified off-premises categories, including contracts signed at your home and during an excursion organised by the trader. Other off-premises situations are not all 30-day cases. An ordinary contract concluded in the operator's shop does not gain this distance/off-premises right just because installation takes place at home.

Send a clear withdrawal statement before the applicable period ends and keep proof of sending. The statutory form is an option, not the only possible clear declaration. This is different from Article 133's minimum 30-day advance notice: do not wait 30 days and miss a cooling-off deadline. If required withdrawal information was not provided, Article 10 has an extended-period rule; get the actual documents checked rather than assuming the ordinary period necessarily settles the case.

Early activation does not by itself erase cooling-off. Where you expressly requested service to begin during the period, a proportionate charge for what was actually provided may be due under Article 15. The law also sets exceptions and information/consent conditions; for a fully performed paid service, Article 17 requires prior express consent and acknowledgement of losing withdrawal. Ask to see the relevant request and contract documents if an operator says any activation automatically removed your right.

How are ordinary early-cancellation charges limited?

Check when the contract was concluded and whether a later change created a new commitment. Law 16/2022's general regime applies to contracts concluded after its entry into force on 14 November 2022. Its Article 9 extends specific protections, including Articles 133 and 137, to existing contracts too, but it does not extend every provision wholesale. For an older agreement, obtain the applicable contractual and legal calculation rather than automatically applying all the new-contract rules below.

For a contract covered by the new regime, Article 136 limits the charge to the lower of the contract's identified benefit, proportionate to the remaining loyalty period, and the applicable percentage of remaining monthly payments. For initial loyalty, the latter limit is 50% during the first year and 30% during the second. A subsequent loyalty period without a change to the installed local loop has a 30% limit; with that change, the initial-period limits apply. The operator cannot simply label all future monthly payments a cancellation penalty.

Ask for the original contract, any renewal, benefit amount, start/end dates and the two calculations. Do not use a headline percentage as the final bill: a lower proportional benefit may govern, and service, unpaid amounts and subsidised equipment are separate questions. Request a written explanation of the rule applied to your particular contract, especially if its dates or renewal history are unclear. Cancellation requirements must not be more burdensome than contracting requirements, and documents already held by the operator cannot simply be demanded again under Article 136.

What should I send, return and keep?

Equipment-return arrangements differ by contract: this guide does not invent a universal 10- or 15-day return period. Photograph what you return as a practical record, but obtain the operator's receipt too. Article 138 treats retaining subsidised terminal equipment as a distinct compensation question even when a legal right permits early termination without a loyalty charge. Returning loaned equipment and choosing to retain subsidised equipment are not the same thing.

Revoking a direct debit changes payment authorisation, not the service contract. Ask for the accepted termination date and challenge a disputed amount in writing rather than treating a blocked payment as proof of cancellation. Send identity, financial or medical evidence only through the operator's verified channels; do not upload private documents, PINs or bank details to a public checklist or Finkavo contact form.

Need to change the payment instruction as well? Use the direct-debit cancellation and refund guide; stopping a collection does not replace notice to the operator.

What if the operator refuses or keeps billing?

Use the complaints-book guide to distinguish an operator complaint, regulator referral and consumer dispute resolution. A complaint alone does not guarantee cancellation or a refund.

First contact the operator with proof of your request and the specific issue: rejected legal ground, missing end-date confirmation, incorrect fee or unrecorded equipment return. Ask for a written response and keep it. If unresolved, the current gov.pt consumer-dispute guide explains how to find the appropriate consumer arbitration centre and the documents to provide. A complaint is not, by itself, a termination confirmation. This guide gives neither an approval guarantee nor an instruction to ignore an outstanding bill.

Moving also involves separate electricity and gas contract checks and official address updates. Keep one checklist but a separate receipt for each outcome; no single cancellation updates every authority and provider.

Frequently asked questions

Can I cancel internet without a penalty when I move house?

Not just because you moved. Article 133 requires a permanent-residence change and the operator being unable to offer the contracted or equivalent service, including characteristics and price, at the new address. Send written notice at least 30 days ahead with proof of the new residence. Service during notice can still be charged.

Can I cancel a telecom contract when leaving Portugal?

Article 133 describes an unpredictable permanent move to a país terceiro, with residence or work/services-contract evidence and at least 30 days' written notice. It is not a blanket waiver for every departure. Article 137 separately provides suspension for residence outside Portugal; request and confirm the appropriate route rather than treating the grounds as identical.

Can I cancel during fidelização and what can the operator charge?

Ordinary early cancellation can have a charge. For contracts covered by the new regime, Article 136 uses the lower of the proportional benefit and the applicable percentage of remaining payments: initial loyalty 50% in year one, 30% in year two; subsequent limits depend on the local loop. Contracts predating 14 November 2022 need the transitional rules checked, not every new-contract rule applied automatically. Ask for an itemised calculation.

Is the cooling-off period 14 days or 30 days?

Generally 14 days from conclusion for a distance service contract. Thirty days applies to the specified off-premises categories, including signing at home. It is not counted from installation, and an ordinary in-shop contract is not covered simply because the service is installed at home. Early service may carry a proportionate charge; information and consent conditions matter.

How much notice do I need to cancel?

The qualifying Article 133 routes require at least 30 days' written advance notice. For contracts covered by the new regime, Article 132 limits notice after automatic extension to at most one month, with service during notice payable. Check transitional rules for an older agreement. Cooling-off is different: send withdrawal before its applicable deadline. Do not apply one deadline to all cases.

Do I have to return the router and TV box?

Check your equipment terms and ask the operator for the items, return route and deadline in writing. Keep an itemised receipt. There is no universal return period asserted here. Retaining subsidised terminal equipment is a separate compensation question under Article 138, even where the service contract can legally end without a loyalty penalty.

Does cancelling a direct debit cancel my internet contract?

No: payment authorisation and contract termination are different. Keep proof of a termination request and obtain the end-date confirmation. Challenge disputed charges with the operator and retain its response; a blocked payment does not prove the contract ended.

What should I do if the operator refuses cancellation?

Ask for its written reason and compare it with your contract, statutory ground, notice and evidence. Complain to the operator first, keeping the correspondence and bills. If unresolved, use gov.pt's consumer-dispute guidance to identify the competent arbitration centre. A complaint does not automatically cancel service or waive a bill.
