Key takeaways
  • IMT normally uses the higher of the contract value and the VPT under CIMT Article 12.
  • The 2026 mainland HPP table is 0% through €106,346; whole-base rates of 6% and 7.5% begin above €660,982 and €1,150,853 respectively.
  • IMT Jovem and qualifying HCC acquisitions use a special first-HPP scale and a capped Stamp Duty deduction; relief can remain partial above the first band.
  • Since 25 May 2026, a non-resident residential acquisition generally faces 7.5% with no relief unless an Article 17(10) exception applies.

IMT is the one-off municipal tax on an onerous acquisition of Portuguese real estate and on other transactions that the CIMT treats as equivalent. The buyer is the taxpayer. It is separate from annual IMI and from the 0.8% Stamp Duty normally charged on the acquisition.

How do I calculate IMT and stamp duty in Portugal?

Start with the higher of the purchase price and VPT, then select the applicable IMT rules for the purchase date, property use, location and buyer's situation. Residential IMT is not one universal flat percentage. Acquisition stamp duty normally adds 0.8% of that same base, unless a relevant exemption applies. Loan-related stamp duty and transaction fees are separate costs.

Does being under 35 automatically mean I pay no IMT or stamp duty?

No. IMT Jovem concerns buyers aged 35 or under, but the first-purchase, permanent-home, property-ownership and IRS-dependant conditions also matter, alongside the value limits. A buyer who is not Portuguese tax resident normally pays a flat 7.5% IMT on a home with no exemption, unless they become resident within two years or let it at a moderate rent (CIMT art. 17(10), from DL 97/2026). AT's relief concerns acquisition stamp duty under item 1.1, not every mortgage or banking charge. Check each buyer separately in a joint purchase and use the current table before assuming the entire purchase is exempt.

Tax base: contract value or VPT

Under CIMT Article 12, the general rule is the higher of the value in the act or contract and the property's VPT. Article 12 has transaction-specific rules for partial property rights, exchanges, partitions and other cases, so a simple price-versus-VPT calculation is not enough for those transactions.

2026 mainland HPP rates

Tax baseRate method
Up to €106,3460%
€106,346–€145,4702% marginal, with statutory deduction
€145,470–€198,3475% marginal, with statutory deduction
€198,347–€330,5397% marginal, with statutory deduction
€330,539–€660,9828% marginal, with statutory deduction
€660,982–€1,150,8536% on the whole tax base
Above €1,150,8537.5% on the whole tax base

Other mainland residential property uses a separate table: the first band is 1%, not 0%, and its 8% band ends at €633,931 before the 6% whole-base band. In the autonomous regions, the 2026 HPP 0% band reaches €132,933, the 6% whole-base band begins above €826,228 and the 7.5% band begins above €1,438,566.

Flat rates and the new non-resident rule

  • Rural property: 5% under CIMT Article 17(1)(d).
  • Other urban property and other onerous acquisitions: 6.5% under Article 17(1)(e).
  • An entity covered by the listed-jurisdiction/control rule: 10%, without exemption or reduction. Article 17(7) excludes natural persons from that rule.
  • A non-resident acquisition of urban property exclusively for housing: generally 7.5%, without exemption or reduction, under Article 17(10), added by Decree-Law 97/2026.

The non-resident rule has three routes out: the buyer was previously treated as Portuguese tax resident; the buyer becomes resident within two years; or the home enters qualifying moderate-rent residential letting within six months and is rented for at least 36 months during the first five years. The latter two routes use a refund request, filed within six months of becoming resident or signing the qualifying lease — the 7.5% is still paid at the deed. These are detailed legal tests, not a simple nationality check.

Two buyers on one deed (AT, Ofício-Circulado 40131/2026, 4 September 2026): co-owners who are not married in comunhão are each judged on their own residence. A married couple buying into common property (comunhão de adquiridos or geral) is ONE taxable event with one IMT assessment: the 7.5% applies to the whole home only if both spouses are non-resident and neither was ever resident; if either is, or ever was, resident, the general scale applies to the whole. The two-year refund route is open if either spouse becomes resident.

IMT Jovem and Stamp Duty

CIMT Article 9 covers a first acquisition exclusively for HPP by a buyer aged 35 or under who is not an IRS dependent in the transfer year. A buyer is excluded if they hold an ownership or partial right over residential urban property at the transfer date or held one at any time in the preceding three years. The article does not impose an income ceiling or three-year Portuguese tax-residence condition. For a home that becomes common property of a married couple, eligibility and tax are checked individually in equal shares.

In 2026 the special scale produces zero IMT through €330,539 on the mainland and €413,174 in the autonomous regions, followed by an 8% band with a statutory deduction. Stamp Duty Article 7-A gives a deduction capped at 0.8% of that first-band ceiling. Therefore, a qualifying purchase above the ceiling does not lose all relief: IMT stays on the special scale and Stamp Duty is reduced by the capped amount.

HCC benefit enacted in 2026

EBF Article 45-B, added by Decree-Law 97/2026, gives a qualifying first acquisition of a controlled-cost home for HPP the same special IMT scale and capped Stamp Duty deduction. The buyer must satisfy the residential-property-right restriction, and the benefit depends on a municipal-assembly resolution proposed by the municipal council. Old municipality-tier price-cap summaries do not describe this current tax benefit.

Payment before the title

CIMT Article 36 now states that IMT must be paid on the assessment day or within the following 30 days, otherwise the assessment lapses. In a normal purchase, the buyer obtains the assessment and payment documents from AT and pays before the deed or authenticated title, because the title professional must verify payment or a valid relief. The notary does not calculate this estimate or collect it as part of the calculator's result.

Estimate my IMT and stamp duty

What this calculator deliberately excludes

Reinvestment of proceeds from a former HPP can affect IRS on the seller's capital gain; it is not a proportional IMT or Stamp Duty reduction on the new purchase. The calculator also does not decide special Article 12 bases, split rights, exchanges, resale-business relief, rehabilitation relief or later loss of an exemption. Use the AT assessment and transaction documents for the final number.

Frequently asked questions

Is stamp duty calculated on the purchase price or the VPT?

For an ordinary property acquisition, use the higher of the contract price and VPT—the same ordinary base used for IMT. For example, a €250,000 price and €200,000 VPT give a €250,000 base and €2,000 of acquisition stamp duty at 0.8%, before any applicable relief. This example does not calculate the IMT or any loan-related charge.

Is IMT calculated on price or VPT?

Normally on whichever is higher under CIMT Article 12. Special transactions can use one of Article 12's specific valuation rules.

Does IMT Jovem disappear completely above €330,539?

No. For a qualifying mainland buyer, IMT continues on the special scale and the Stamp Duty deduction is capped at 0.8% of €330,539. The excess can therefore remain taxable while part of the benefit survives.

Do all co-buyers have to qualify for IMT Jovem?

Eligibility is assessed per buyer. Article 9 expressly requires an individual equal-share assessment when the property becomes common property of a married couple. Mixed-eligibility ownership needs share-specific AT treatment.

Does reinvesting the sale proceeds from my old home reduce IMT?

No. Reinvestment belongs to the IRS capital-gains analysis of the sale; it does not proportionally reduce IMT or Stamp Duty on the acquisition.

What is the 2026 non-resident IMT rate?

For an urban property exclusively for housing, Article 17(10) generally imposes 7.5% with no relief, subject to its prior-residence, future-residence and qualifying moderate-rent exceptions.
