NHR and IFICI: Portugal's Tax Regimes for New Residents, Explained
NHR made Portugal famous among relocating professionals and retirees. It's gone for almost everyone now — here's what replaced it, who still qualifies for the old rules, and what the new regime is actually built for.
- NHR (Non-Habitual Resident) closed to new, ordinary applicants once the 2024 state budget repealed it — only people who could prove they'd already started their move to Portugal before the cutoff kept a path into the old rules.
- IFICI, nicknamed "NHR 2.0," replaced it from 2024 onward — but it's narrowly aimed at certified research, innovation, and highly qualified roles at specific categories of employer, not open to anyone simply relocating.
- IFICI applies a 20% special rate to net Portuguese Category A/B income from eligible activities and exempts foreign Category A, B, E, F and G income with progression, subject to the special rule for listed low-tax jurisdictions; pensions are outside the exemption.
- The bars between NHR, IFICI, IRS Jovem and Programa Regressar are specific, not mutual: anyone who has ever had NHR or IFICI, or opted for Regressar, can never get IRS Jovem (art. 12.º-B n.º 9 CIRS), and IFICI is closed to past NHR and Regressar users (art. 58.º-A n.º 10 EBF) — but having used IRS Jovem does not bar IFICI or Regressar.
The Non-Habitual Resident (NHR) regime was Portugal's decade-long calling card for relocating professionals, remote workers, and retirees — a flat 20% rate on certain Portuguese income and broad exemptions on foreign-source income for 10 years. The 2024 state budget (Lei n.º 82/2023) repealed it with effect from 1 January 2024. In its place, the same law created IFICI, the Tax Incentive for Scientific Research and Innovation — informally called "NHR 2.0" — which is a genuinely different, narrower regime, not a rebrand.
What is the IFICI tax regime in Portugal?
IFICI is the Tax Incentive for Scientific Research and Innovation under Article 58-A of the EBF. It can apply to Portuguese and foreign citizens who become tax resident after five years of non-residence and exercise a qualifying activity. It is not a benefit granted merely for moving to Portugal, holding a D7/D8 visa or having a foreign employer.
How do I apply for IFICI, and what is the deadline?
Submit the application on Portal das Finanças and identify the activity route and competent body. The ordinary deadline is 15 January of the year after becoming Portuguese tax resident: a qualifying new resident in 2026 would apply by 15 January 2027 under the rules checked here. A late application takes effect from the application year and uses only the remainder of the original ten-year period. Do not reuse the expired transitional 2024 deadlines.
Is NHR still open in 2026? Short answer: only if you were grandfathered in
NHR is not open to ordinary new applicants in 2026. The repeal law kept a transitional door open (Article 236 of Lei n.º 82/2023) for people who could show they were already, verifiably, in the process of moving to Portugal before the regime closed — for example, a residence-visa application filed, a lease or property-purchase agreement signed, or children already enrolled in Portuguese schooling, by dates in late 2023, followed by becoming Portuguese tax resident by 31 December 2024 and registering as NHR by 31 March 2025.
The Tax Authority (AT) has read that grandfather clause strictly. In one binding ruling, a taxpayer who held Portuguese nationality but hadn't yet moved — citing documented health reasons for the delay — argued their nationality application and birth-registration process, both started before the cutoff, should count as equivalent to a residence-visa procedure. The AT refused: the law's transitional conditions require a genuine, demonstrable immigration procedure or property/rental commitment started by the relevant 2023 date, not merely an intention to relocate. Case law from the Supreme Administrative Court and CAAD arbitration has separately confirmed that registering as NHR is a declarative formality, not what creates the right — but you still have to meet the substantive conditions in the first place.
Because these cutoffs have shifted with nearly every state budget since 2020, don't treat any specific date here as guaranteed to still apply — confirm the current grandfather conditions and any residual deadlines directly on the Portal das Finanças before assuming you qualify.
What NHR actually pays out, if you're still inside the 10-year window
- Portuguese-source employment or self-employment income from a list of "high value-added" activities: flat 20% rate, instead of the standard progressive IRS brackets.
- Foreign-source employment income: exempt (with progression), if it was taxable in the source country under a tax treaty, or, absent one, was actually taxed there and that country isn't a blacklisted jurisdiction.
- Foreign-source self-employment, capital, rental, and capital-gains income: exempt under broadly similar source-country conditions.
- Foreign pensions: taxed at a flat 10% (CIRS art. 72.º n.º 12, Lei 2/2020). The old full exemption continued for the rest of the 10-year window for anyone already registered, or with a request pending, on 1 April 2020, and for anyone resident then who registered by 31 March 2020 or 2021 (conditions met in 2019 or 2020); those could also opt into the 10% rules (Lei 2/2020 art. 329.º n.os 2–4).
- Duration: 10 consecutive years from the year of registration, non-renewable and non-extendable — there's no way to reset the clock or apply twice.
IFICI: who it's actually built for
IFICI is not a general relocation incentive. You must become Portuguese tax resident after five years of non-residence and earn Category A or B income from an activity listed in Article 58.º-A. Whatever the route, the application is filed on the Portal das Finanças; the AT's IFICI leaflet says the request «deve ser apresentado no Portal das Finanças… independentemente da atividade exercida». The public body named for your route then verifies the activity, and the AT verifies the other legal conditions. Under Portaria 352/2024, the ordinary application deadline is 15 January of the year after becoming resident; a late registration only takes effect from the registration year and does not restart the ten-year period.
- Higher-education teaching, scientific research, scientific employment and jobs or board roles at recognised technology and innovation centres; verified by FCT.
- Qualified jobs and board roles under contractual benefits for productive investment; verified by AICEP.
- Professions in Portaria 352/2024 at qualifying RFAI companies, or at listed industrial/service companies meeting the 50% export test; this route is verified by the AT and has qualification/experience rules.
- Other qualified jobs and board roles at entities whose activities AICEP or IAPMEI recognises as relevant to the national economy.
- R&D personnel whose costs qualify under SIFIDE; verified by ANI.
- Jobs and board roles at entities certified as startups; verified by Startup Portugal.
- Activities in the Azores or Madeira only where covered by the applicable regional legislative rules.
You also cannot have benefited from NHR or IFICI before, and you cannot have opted for Programa Regressar; IFICI itself can be used only once. Being a retiree or remote worker does not create eligibility by itself: the taxpayer still needs qualifying Category A or B income through one of the statutory activity routes. A D8 visa does not give you IFICI either: see ourD8 visa taxes guide.
IFICI's benefit mechanics
- Portuguese-source Category A/B income from an eligible activity: flat 20% rate, mirroring NHR's headline rate.
- Foreign-source Category A, B, E, F and G income: the exemption method applies and the income is included to determine the rate on other income. Article 81.º contains a separate treatment for amounts paid or made available by entities in a listed low-tax jurisdiction; do not assume the ordinary exemption applies to them.
- Foreign pensions (Category H): explicitly not covered. They're taxed under the ordinary general IRS rules — the single biggest substantive difference from classic NHR, whose 10% pension rate (or full exemption for earlier registrants) doesn't carry over.
- Duration: 10 consecutive years from the year you register as resident, non-renewable — same structure as NHR, different substance.
| NHR (legacy) | IFICI | |
|---|---|---|
| Portuguese-source A/B rate | 20% | 20% |
| Foreign-source A/B/E/F/G | Legacy NHR rules vary by category | Exempt with progression; low-tax-list rule applies |
| Foreign pensions (Category H) | 10% (post-2020 registrants) | Not covered — general IRS rules |
| Eligibility basis | Legacy qualifying activity | One of Article 58.º-A's activity routes |
| Registration route | AT registration | Portal das Finanças; the body named for the Article 58.º-A route verifies |
| Duration | 10 years, non-renewable | 10 years, non-renewable |
| Open to new applicants in 2026? | No, except narrow grandfather cases | Yes, if activity/employer qualify |

Check my IFICI eligibilityHow to apply for IFICI: evidence, submission and decision
- Identify the exact Article 58.º-A route
AT FAQ 5498 maps activity routes to FCT, AICEP, AT, IAPMEI, ANI or Startup Portugal, with separate regional provisions. Ask the employer which paragraph and proof apply: a job title alone does not establish the company's eligibility.
- Prepare the document pack for that route
FAQ 5523 gives examples: employment contract, qualifications, company declaration, or corporate/research evidence. This is not a universal checklist. Different routes and cases can require additional documents.
- Apply through Portal das Finanças and save the receipt
The current ordinary deadline is 15 January after the residence year: residence beginning in 2026 means 15 January 2027. Late registration only uses the remaining original benefit period; it does not restart ten years.
- Check the decision, not just the upload
AT says registration information is made available by 31 March. Read the reserved-area result and answer document requests within the notification's deadline. Keep evidence of continued eligibility. A checker result is not approval.

Why you can't stack NHR, IFICI, IRS Jovem, and Programa Regressar
Each regime has its own exclusion list, and the bars only run in the directions the law sets. Article 12-B(9) of the IRS Code bars anyone who "benefits or has benefited from" NHR or IFICI, or who opted for Programa Regressar (the returning-emigrant regime), from claiming IRS Jovem. Article 58-A(10) of the EBF bars IFICI for anyone who has benefited from NHR or opted for Regressar. Regressar itself is closed to anyone who applied for NHR (art. 12-A(2) CIRS). No rule bars IFICI or Regressar because you used IRS Jovem earlier. You still cannot run two of these regimes on the same income at once, so choose with the order in mind.
There's one useful edge case worth knowing: if you're formally registered as NHR but never actually claimed the benefit on a tax return (no Anexo L ever filed), a binding AT ruling confirms you can ask the tax authority's taxpayer-registration department to cancel that NHR registration — since it's a benefit granted on request, not an automatic one, it can be renounced. Once cancelled, you're free to claim IRS Jovem instead, if you otherwise qualify. Simply not filing Anexo L is not, by itself, treated as having renounced NHR — you have to formally request the cancellation.
Frequently asked questions

What tax benefits does IFICI offer to foreigners?
Nationality is not the eligibility test. IFICI provides a 20% special IRS rate on net Portuguese Category A/B income from qualifying activities for a ten-year period, with the option for aggregation. Foreign-source income generally has a separate exemption, but foreign pensions are excluded and income from listed low-tax jurisdictions has special 35% rules. The 20% rate does not apply to every income category or every job.

Is IFICI governed by Article 58 or Article 58-A of the EBF?
IFICI is governed by Article 58-A (58.º-A), not simply Article 58. Article 58-A defines the activity routes, the 20% rate, the ten-year period, continuity requirements and exclusions. Portaria 352/2024/1 supplies the registration and activity rules. A profession on a list is only one part of the test: employer, activity, qualifications and residence conditions must also fit the applicable route.

Which documents do I need, and can a freelancer qualify?
Documents depend on the route: AT examples include an employment contract, academic qualifications, an employer statement, a scholarship contract or a commercial-register certificate for a board role. Some routes permit Category B work, but a qualifying job position requires an employment contract; providing services to a qualifying company does not automatically create eligibility. Check your exact legal route rather than treating every freelancer or IT worker as eligible.

What happens if I change employer while using IFICI?
The ten-year clock does not restart. Where the registration details or competent entity change, AT says to communicate the change by 15 January of the following year and submit a new application under the ordinary rules. Starting another qualifying activity within six months can preserve continuity. Losing the legal conditions ends the benefit; an approved registration is not a guarantee of ten eligible years regardless of later activity.

Does my IFICI application receipt mean I have been approved?
No. Save the submission receipt, then consult the registration information that AT says is available by 31 March. The competent body verifies the activity and AT checks the remaining conditions. If further documents are requested, follow the notification's deadline; a successful upload or checker result is not approval.

Can a freelancer qualify for IFICI just by invoicing an eligible company?
Not automatically. FAQ 5501 accepts a university teaching-services case if the other conditions are met; FAQ 5502 distinguishes an employment post from a services contract. FAQ 5526 explains how freelancers identify the relevant entity. Verify the exact route: an invoice or CAE alone is insufficient.

Can I still apply for NHR in 2026?
Not through the ordinary route — NHR closed to new applicants once the 2024 state budget repealed it. The only path in is the transitional "grandfather" clause for people who had already, demonstrably, started moving to Portugal before the cutoff (a residence-visa procedure, a signed lease or purchase agreement, school enrollment for dependents) and completed registration by the deadline that followed. Given how often these dates have moved, confirm on the Portal das Finanças whether any residual window still applies to your situation rather than assuming it's fully closed or still open.
What's the real difference between NHR and IFICI?
Eligibility, administration and pension treatment. IFICI covers only the activity routes in Article 58.º-A, filed on the Portal das Finanças and verified by the body named for each route; the ordinary application deadline is 15 January after the residence year. IFICI does not include foreign pensions in its foreign-income exemption, while legacy NHR has its own pension rules.
Who actually qualifies for IFICI?
A new resident after five years of non-residence who earns Category A or B income through one of Article 58.º-A's routes and completes the relevant verification. Routes include higher education/research and technology centres, investment-contract roles, specified highly qualified professions at qualifying companies, nationally relevant activities recognised by AICEP/IAPMEI, SIFIDE-eligible R&D staff, certified startups, and activities covered by regional rules in the Azores or Madeira.
Can I combine NHR or IFICI with IRS Jovem or Programa Regressar?
Not at the same time. The bars are specific: past NHR or IFICI, or an opted-for Regressar, rules out IRS Jovem for good (art. 12.º-B n.º 9 CIRS); past NHR or Regressar rules out IFICI (art. 58.º-A n.º 10 EBF); an NHR application rules out Regressar (art. 12.º-A n.º 2 CIRS). Having used IRS Jovem does not bar IFICI or Regressar later.
I'm registered as NHR but never actually used the benefit — can I switch to IRS Jovem?
According to a 2025 binding ruling from the Tax Authority, yes — if you never claimed the NHR benefit on a tax return (no Anexo L ever filed), you can formally request cancellation of your NHR registration from the AT's taxpayer-registration department. Once cancelled, you can claim IRS Jovem instead if you meet its conditions. Just not filing Anexo L on its own isn't treated as a renunciation — you need the formal cancellation request.
